Record fine for packaging waste

The Environment Agency reported this week that a fine of £261,278 was handed out to the Red Bull Company Limited after it failed to register as a Packaging waste producer and to fulfil their requirement to recover and recycle packaging waste. The London-based soft drinks importer pleaded guilty at Southwark Crown Court to charges of failing to meet their obligations under the Regulations for the eight years between 1999 and 2006.

This record-breaking fine overtakes the previous record of £225,000 imposed in January 2008 and once again highlights the need for organisations to ensure their compliance with the Producer Responsibility Obligations (Packaging Waste) Regulations 2007.

Under the so-called Packaging Regulations, which have been in existence for over a decade, businesses which have an annual turnover in excess of £2 million and use more than 50 tonnes of packaging each year, must be registered with the Environment Agency or a compliance scheme. They must also provide evidence that they are either recycling, or paying for the provision of recycling for a required proportion of their waste.
